Introduction

Welcome to CarCheki ("we," "our," or "us"). These Terms of Service ("Terms") govern your access to and use of the CarCheki platform, website, mobile applications, and related services (collectively, the "Services").

CarCheki is Ghana's vehicle history report platform, providing VIN-based car history checks to consumers in Ghana and Nigeria. By accessing or using our Services, you agree to be bound by these Terms and our Privacy Policy.

1. Acceptance of Terms

By creating an account, purchasing a VIN report, or using any part of our Services, you acknowledge that:

• You have read, understood, and agree to be bound by these Terms
• You are at least 18 years of age or the age of majority in your jurisdiction
• You have the legal capacity to enter into a binding agreement
• You are a resident of Ghana or have the legal right to use our Services
• You will comply with all applicable laws and regulations

2. User Accounts

2.1 Account Registration

To access certain features of our Services, you must register for an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain and promptly update your account information
• Keep your password secure and confidential
• Notify us immediately of any unauthorized access to your account
• Accept responsibility for all activities that occur under your account

2.2 Account Information

To purchase VIN reports, you must provide accurate personal information. We collect only what is necessary to process your payment and deliver your report. A free preview is available without creating an account.

3. Service Rules

3.1 Permitted Use

CarCheki is intended for personal use to check the history of a vehicle you are considering purchasing or selling. Permitted uses include:

• Running VIN checks on vehicles you are considering buying
• Checking the history of a vehicle you own or are selling
• Using a CarChekiReport as one factor in a purchase decision
• Sharing a CarChekiReport as part of a private vehicle sale

3.2 Prohibited Use

You may not use CarCheki to:

• Conduct bulk commercial VIN lookups without an API agreement
• Resell or republish CarCheki report data
• Use automated bots or scrapers to access our data
• Attempt to reverse-engineer or circumvent our reporting system
• Submit fraudulent or false information
• Violate any laws or regulations
• Infringe on intellectual property rights

3.3 Vehicle Data Accuracy

CarChekiReport data is sourced from third-party providers, public records, and partner databases, and is provided on an "as-is" basis. While we work to deliver accurate and up-to-date information, CarCheki does not guarantee that every record is complete or error-free, and you should use the CarChekiReport as one factor in your decision rather than a sole determinant.

4. Payments

4.1 Pricing

CarCheki offers flat, transparent pricing with no hidden fees:

• Free Report: GH₵0 — a free preview summary of a vehicle's history
• Full Report: GH₵500 — the complete CarChekiReport with all checks

4.2 Payment Methods

The Full Report is a one-time, per-report charge billed at the time of purchase. You can pay using:

• Mobile Money — MTN MoMo, Vodafone Cash, or AirtelTigo Money
• Debit or credit card

4.3 Refunds

Each Full Report purchase is charged once per report. If a report fails to generate or contains a processing error, you may be eligible for a refund. Please review our Refund Policy for full details.

5. Limitation of Liability

To the maximum extent permitted by law:

• CarCheki is not responsible for inaccuracies in third-party vehicle history data
• We are not liable for any loss or damage arising from your use of the Services
• Our total liability shall not exceed the fees paid by you in the last 12 months
• We do not guarantee continuous, uninterrupted access to the Services

6. Intellectual Property

All content on CarCheki, including logos, trademarks, text, graphics, and software, is owned by or licensed to CarCheki. You may not copy, modify, distribute, or create derivative works without our express written permission.

By posting content on our platform, you grant CarCheki a non-exclusive, royalty-free license to use, display, and distribute such content in connection with our Services.

7. Termination

We may suspend or terminate your account at any time for:

• Violation of these Terms
• Fraudulent or suspicious activity
• Non-payment of fees
• Extended inactivity
• Any other reason at our sole discretion

8. Dispute Resolution

Any disputes arising from these Terms or your use of the Services shall be:

• First, attempted to be resolved through informal negotiation
• If unsuccessful, submitted to mediation in Accra, Ghana
• Governed by the laws of the Republic of Ghana
• Subject to the exclusive jurisdiction of Ghanaian courts

9. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes via email or through the platform. Your continued use of the Services after such modifications constitutes acceptance of the updated Terms.
